Terms of Service

1. Acceptance of Terms

By creating an account, installing the Figma plugin, running the companion server, or otherwise accessing or using Trio — AI 2 Design ("Trio," "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you") and Trio — AI 2 Design, a product of ai2.design, operated by BEY AGENCY LTD ("we," "us," "our") governing your use of the Service.

2. Description of Service

Trio is an AI-powered Figma plugin that generates, modifies, and exports UI designs using natural language prompts. The Service consists of:

1. Figma Plugin — the user interface installed from Figma Community
2. Companion Server — locally-installed software that handles AI communication
3. Cloud Services — authentication, usage tracking, subscription management (via ai2.design)
4. AI Processing — design generation powered by Anthropic's Claude AI (third-party service)

The Service requires:

• An active Trio account (free or paid)
• A separate Claude Pro or Claude Team subscription from Anthropic
• Node.js 18+ runtime on your local machine
• Figma Desktop or Figma in browser

3. Account Registration

3a. Eligibility

You must be at least 16 years of age to create an account and use the Service. By registering, you represent that you meet this age requirement.

3b. Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that show signs of unauthorized access or misuse.

3c. Account Information

You agree to provide accurate, current, and complete information during registration and to update it as necessary. We may verify your email address through a confirmation process.

4. Subscription Plans and Billing

4a. Plans

Trio offers the following plans:

Plan details, limits, and pricing are subject to change. We will notify existing subscribers at least 30 days before any pricing changes take effect on their accounts.

4b. Billing and Payment

• Payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
• Subscriptions are billed in advance on a monthly or yearly basis.
• All prices are in USD unless otherwise stated.
• You authorize us to charge the payment method on file for recurring subscription fees.

4c. Cancellation and Refunds

• You may cancel your subscription at any time from your dashboard or by contacting support.
• Cancellation takes effect at the end of the current billing period — you retain access until then.
• We do not offer prorated refunds for partial billing periods.
• Yearly subscriptions may be eligible for a refund within the first 14 days if you have not exceeded the Free tier usage limits during that period.

4d. Free Plan

The Free plan is provided at no cost and may be used indefinitely. We reserve the right to modify Free plan limits with 30 days' notice. Free plan users are not guaranteed the same level of availability as paid subscribers.

5. Claude AI Subscription (Third-Party Requirement)

Trio requires a separate subscription to Anthropic's Claude AI service. This is a separate, independent subscription not managed or billed by us.

• We are not responsible for Claude AI availability, performance, or pricing
• Changes to Anthropic's pricing, terms, or service do not entitle you to a refund from Trio
• Your use of Claude AI is governed by Anthropic's own Terms of Service
• If your Claude subscription is canceled or expires, Trio cannot process prompts

6. Acceptable Use

You agree to use the Service only for lawful purposes. You may NOT use Trio to:

1. Generate harmful content — designs that promote violence, hate speech, harassment, or illegal activities
2. Infringe intellectual property — create designs that copy, replicate, or misappropriate copyrighted material, trademarks, or trade secrets of others
3. Deceive or defraud — generate designs for phishing, scam websites, or fraudulent purposes
4. Circumvent restrictions — bypass plan limits, share accounts, or use automated tools to exceed usage quotas
5. Reverse engineer — decompile, disassemble, or reverse engineer the companion server or plugin beyond what is permitted by applicable law
6. Resell the Service — offer Trio's capabilities as your own product or service without our written consent
7. Abuse infrastructure — overload, disrupt, or interfere with our servers or third-party services
8. Violate third-party terms — use the Service in ways that violate Figma's, Anthropic's, or Stripe's terms of service

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on the severity of the violation.

7. Intellectual Property

7a. Your Designs

You own your designs. All designs generated by Trio in your Figma file are your intellectual property. We claim no ownership, license, or rights to designs you create using the Service.

This includes:

• UI layouts, screens, and components generated by Design Mode
• Prototype interactions created by Prototype Mode
• Code exported by Code Mode
• Any modifications, iterations, or derivatives you make

7b. Our Service

Trio's software, including the Figma plugin, companion server, MCP tools, system prompts, design system specifications, and website content, is our proprietary property protected by intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the Service as described in these Terms. This license does not include the right to:

• Copy, modify, or distribute the software
• Use the software to build a competing product
• Extract or reuse design system specifications outside of Trio

7c. Design Systems

The design system specifications bundled with Trio (shadcn/ui, AlignUI, etc.) are included for use within Trio to generate accurate designs. The original design systems are the property of their respective creators. Your use of generated designs that follow these design systems is governed by each design system's own license.

7d. Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback to improve the Service without obligation to you.

8. Disclaimers

8a. "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY.

8b. AI-Generated Content

Designs and code generated by Trio are produced by artificial intelligence and may contain:

• Visual inconsistencies or design errors
• Code that requires additional testing before production use
• Approximations of design system specifications
• Unexpected or unintended output

You are responsible for reviewing, testing, and validating all AI-generated output before using it in production applications.

8c. Third-Party Services

We do not guarantee the availability, accuracy, or performance of third-party services (Anthropic, Supabase, Stripe, Figma). Service interruptions caused by third parties are outside our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

1. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
2. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim
3. We are not liable for any loss of data, designs, or work product resulting from Service interruptions, bugs, or third-party failures
4. We are not liable for any damages resulting from your reliance on AI-generated designs or code without independent verification

10. Indemnification

You agree to indemnify, defend, and hold harmless Trio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

1. Your use of the Service
2. Your violation of these Terms
3. Your violation of any third-party rights
4. Designs or code you create using the Service
5. Your end users' interaction with products built using Trio-generated designs or code

11. Team Accounts

11a. Team Owner Responsibilities

If you create a Team, you are the "Team Owner" and are responsible for:

• All activity by team members under your Team subscription
• Ensuring team members comply with these Terms
• Managing team membership and roles
• Payment for all seats under your Team plan

11b. Team Member Obligations

Team members must:

• Maintain their own account security
• Comply with both these Terms and any additional team policies set by the Team Owner
• Not share account credentials

11c. Team Termination

When a team member is removed, their account reverts to the Free plan. Any Prompt Templates they created remain with the team.

12. Termination

12a. By You

You may terminate your account at any time by:

• Canceling your subscription from the dashboard
• Requesting account deletion at hello@ai2.design

12b. By Us

We may suspend or terminate your account if you:

• Violate these Terms or the Acceptable Use Policy
• Fail to pay subscription fees after grace period
• Engage in activity that threatens the security or integrity of the Service

12c. Effect of Termination

Upon termination:

• Your access to the Service ceases immediately (or at end of billing period for voluntary cancellation)
• Your designs in Figma remain yours — we cannot and do not delete your Figma files
• We will delete your account data upon request, subject to legal retention requirements
• Any unused subscription period is not refunded unless required by applicable law

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom. Any disputes arising from these Terms shall be resolved through good-faith negotiation first, followed by the courts of London, United Kingdom.

14. Changes to These Terms

We may revise these Terms from time to time. When we make material changes:

• We will update the "Effective Date" at the top
• We will notify users via email and/or in-app notification at least 30 days before changes take effect
• Continued use after the effective date constitutes acceptance
• If you disagree with changes, you may cancel your subscription before the effective date

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, EULA, Acceptable Use Policy, and Cookie Policy, constitute the entire agreement between you and Trio regarding the Service.
